Leasing your HOME

If you decide to lease your home, you will need to understand the rules and process to follow.  Hopefully, this checklist and the attached documents will assist you in the process.  

Key Leasing Rules:  

Lease & Tenant Restrictions: (See further detail in 7/3/2016 Amendment under Key HOA Documents)

  1. No Unit owner may lease until after holding title for 12 months.
  2. Unit owner must be paid up to date with assessments.
  3. No term of less than 3 months allowed, & unit cannot be leased more than 2x’s in 12-mo period
  4. No individual rooms or subleasing is permitted
  5. No commercial use or use as a group home, bed and breakfast or transient tenant
  6. Any guest, invitee or licensee of a Unit Owner or of a tenant staying at a unit > 30 days in a 12-month period shall be deemed a tenant and shall be subject to all of the above.
  7. Both New and Renewal Leases must follow the Checklist below.

Checklist for New and Renewal Leases:

  • Send the following key items to the Crosswinds Property Manager
  1. A completed application or other as requested by BOD (See Sales and Lease App Package attached below)
  2. Fully executed and legible copy of lease
  3. A transfer fee in the amt equal to the lesser of $100 per applicant or max permitted by Florida Statue
  4. Security deposit of one month’s rent must be provided to the Corporation. This will be for any damages incurred to common property during the tenant's stay and will be refunded within 30 days upon property inspection after the tenant has vacated the property.  You, as homeowner may want to require an incremental security deposit for owner protection for damage.
  5. Tenant Signed Agreement on Rules Compliance. Unit Owner must make available to each tenant copies of Crosswinds governing documents and tenant signs before a notary a document attesting to agreement to comply. Corporation may take action to terminate lease in not observing rules & regulations or causing damage to common property. 
  • The property management company will perform a background check and the Board will approve or disapprove the proposed lease to a particular tenant. Notification of approval/disapproval will be sent to Owner.

Note: Unit Owner must make available to each tenant copies of Crosswinds governing documents and tenant must sign before a notary a document attesting to agreement to comply. Corporation may take action to terminate lease in not observing rules & regulations or causing damage to common property.
